What these terms cover

These terms govern the website only. They are not the terms on which the Cofibrant product is licensed. Any use of the compiler toolchain is governed by a separate written agreement between us and your organisation, and nothing on this website forms part of that agreement or varies it.

The site carries no accounts, no login and no facility to upload or publish content, so there is nothing here for you to be responsible for beyond the messages you choose to send us.

Using the site

You may read, browse, and print or download pages from this site for your own use and for evaluating Cofibrant inside your organisation. You may quote and cite our research with attribution.

You may not republish our material as your own, sell it, or present it as the output of anyone other than Cofibrant. You may not attempt to gain unauthorised access to the site or to any system connected to it, interfere with its availability, or use automated means to place an unreasonable load on it. Ordinary search engine indexing is welcome.

If you are looking for a security issue in this site rather than trying to break it, our vulnerability disclosure policy sets out what is in scope and how to report what you find.

Our research and published measurements

This site publishes benchmark results, security analysis and technical writing. All of it is provided for information.

Every measurement we publish was taken on specific hardware, with a specific toolchain, on specific workloads, and under the methodology described alongside it. Performance depends heavily on the code being compiled and on the machine it runs on, so results in your environment will differ from ours. Nothing in our published figures is a representation, warranty or commitment that you will see the same numbers, and it should not be read as one.

Where we describe the guarantees the product provides, that description is a summary written for a general reader. The precise scope of any guarantee, and any conditions attached to it, are set by the written agreement covering your use of the product. Where the two differ, the agreement governs.

Our analysis of vulnerabilities, threat trends and third-party technologies reflects our view at the time of writing. We update pages as our understanding changes and we do not undertake to keep every page current.

Nothing on this site is legal, regulatory or compliance advice. Decisions about how you meet your own obligations remain yours.

Things you send us

If you send us feedback, questions or suggestions about the product or the site, we may use them freely and without owing you anything for them. Please do not send us confidential information through this site. If you need to share something confidential, tell us first and we will agree how to handle it.

Vulnerability reports are treated differently. We handle those confidentially, on the terms set out on the security page.

Intellectual property

The content of this site, including its text, research, diagrams, code and design, belongs to Cofibrant, Inc. or to our licensors, and is protected by copyright and other rights. The Cofibrant name and logo are our trade marks. The rights we grant you above are the only rights you get; we reserve everything else.

Third-party names and marks that appear on this site belong to their owners and are used to identify them. Their appearance does not imply any endorsement of Cofibrant by them, or by us of them.

Links to other sites

We link to external research, standards and tooling where it helps the reader. We do not control those sites and we are not responsible for their content, their accuracy or their privacy practices. Following a link is at your own discretion.

Availability

We may change, suspend or withdraw any part of this site at any time, and we may change these terms. Changes take effect when posted, and the date at the top of this page tells you when we last made one. We do not promise the site will be available without interruption or free from error.

Disclaimer and liability

The site and its content are provided as they are, without warranty of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement, to the fullest extent the law allows.

We are not liable for indirect or consequential loss, or for loss of profit, revenue, data, or business opportunity, arising from your use of this site or your reliance on anything published on it. Our total liability arising out of the website, on any basis, is limited to one hundred US dollars.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

These limits apply to the website. They do not limit or replace whatever liability provisions are agreed in the written agreement covering your use of the product.

Governing law

These terms and any dispute arising from them are governed by the laws of the State of Delaware, without regard to its conflict of laws rules, and the courts of Delaware have jurisdiction. If you are a consumer resident elsewhere, you keep the benefit of any mandatory protections of your local law, including the right to bring proceedings in your local courts.

General

If any part of these terms is found unenforceable, the rest continues to apply. If we do not enforce a term straight away, we have not given it up. These terms are the whole agreement between us about your use of the website, and they do not give rights to anyone who is not a party to them.
